Data Breaches:   Effective July 1, 2015 S.B. 35 and S.B. 36 increase privacy protections and expand the definition of personal identifying information in conjunction with the state’s data breach notification statute.

S.B. 35 provides additional data breach notification requirements, including that a notice be “clear and consistent” and include at minimum:A toll-free number to contact the organization;Types of PII affected; A general description of the breach; Approximate date of the breach; General actions taken to protect against further breach; Advice relating to reviewing account statements and monitoring credit reports; and Whether the notification was delayed due to law enforcement.

S.B. 36 broadens the definition of (PII) that applies to protections under the statute. This includes a combination of first and last name with one or more of the following: Social Security or driver’s license number; Financial account number with security code; Tribal, Federal, of state issued identification card; Username or email address with password or security question and answer; Birth or marriage certificate; Medical information; Health insurance information; Unique biometric information; or Individual taxpayer identification number.
